Service Description

Clear Check (“the Service”) is an online AML/CTF compliance screening platform operated by Clear Check Pty Ltd (“we”, “us”, “our”). The Service enables Australian professionals to conduct compliance screening checks against government databases and sanctions lists.

The Service includes:

• Screening individuals and entities against the DFAT Consolidated Sanctions List
• ABN verification via the Australian Business Register
• PEP (Politically Exposed Person) screening via the OpenSanctions dataset
• PPSR, ASIC, and AFSA searches (where applicable to your subscription plan)
• Compliance report generation with full audit trail
• AML/CTF program templates, risk assessment tools, and training resources

Account Terms

• You must be at least 18 years of age and an Australian resident or business to use the Service
• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised access to your account
• One person or legal entity may not maintain more than one account
• You are responsible for all activity that occurs under your account

Team Accounts

If you invite team members to your account, you are responsible for their use of the Service. You may set role-based permissions to control access levels within your organisation.

Payment Terms

• All prices are quoted in Australian dollars (AUD) and are inclusive of GST
• Subscription fees are billed monthly or annually in advance, depending on your chosen plan
• Per-check fees (PPSR, ASIC, AFSA) are charged at the time of the check and appear on your next invoice
• Payment is processed securely through Stripe with Australian processing
• Failed payments may result in service suspension after a 7-day grace period
• Refunds are available within 14 days of initial subscription purchase if no screening checks have been performed

Price Changes

We may adjust pricing with 30 days written notice. Price changes will take effect at the start of your next billing cycle. You may cancel your subscription before the new pricing takes effect.

Acceptable Use

You agree to use the Service only for lawful compliance screening purposes. You must not:

• Use the Service for any purpose other than genuine AML/CTF compliance screening
• Attempt to access, scrape, or extract data beyond what is provided through the Service interface
• Share your account credentials or allow unauthorised third parties to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harass, stalk, or discriminate against any individual
• Submit false or misleading information for screening purposes
• Resell, sublicence, or redistribute screening results without written permission
• Interfere with or disrupt the integrity or performance of the Service

Disclaimers

• The Service is provided “as is” and “as available” without warranties of any kind, express or implied
• We do not guarantee the completeness, accuracy, or timeliness of data sourced from third-party government databases
• Screening results reflect data available at the time of the check and may not capture all relevant information
• A “clear” screening result does not constitute a guarantee that a person or entity poses no AML/CTF risk
• Government database availability is subject to the uptime of third-party API providers

Liability Limitations

To the maximum extent permitted by Australian law:

• Our total aggregate liability to you for any claims arising from or relating to the Service is limited to the amount you have paid us in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss arising from your reliance on screening results without independent verification
• We are not liable for any penalties, fines, or sanctions imposed on you by AUSTRAC or any other regulatory body
• We are not liable for any service interruptions caused by third-party government database outages

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

Termination

By You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date.

By Us

We may suspend or terminate your account if:

• You breach these Terms of Service
• Your payment method fails and remains unresolved after the grace period
• We reasonably believe your use of the Service is fraudulent or unlawful
• Required by law or regulatory order

Effect of Termination

Upon termination, you may request an export of your screening records and compliance reports within 30 days. After 30 days, account data will be deleted in accordance with our data retention policy. Screening audit trail records will be retained for 7 years as required by law.

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Notify you by email at least 30 days before the changes take effect
• Display a notice within the Service dashboard
• Update the “Last updated” date at the top of this page

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you should discontinue use and cancel your subscription before the effective date.
